By accessing or using BantuCart's platform, website, mobile application, or services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Description of Service

BantuCart is an e-commerce and food delivery platform that connects:

• Customers with shops and restaurants for ordering products and food
• Shop Owners with customers to sell their products
• Network Marketers with opportunities to earn commissions through referrals
• Couriers with delivery opportunities

3. User Accounts

3.1 Account Registration

To use certain features of our platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Account Types

Different account types (Customer, Shop Owner, Network Marketer, Courier) have different responsibilities, rights, and obligations as outlined in these Terms and our platform policies.

4. Shop Owner Terms

If you register as a Shop Owner, you agree to:

• Provide accurate business information and documentation
• Maintain product quality and accurate product descriptions
• Process orders in a timely manner
• Comply with all applicable laws and regulations
• Pay applicable fees and commissions
• Respond to customer inquiries and resolve disputes professionally

5. Network Marketer Terms

If you register as a Network Marketer, you agree to:

• Provide accurate personal and identification information
• Comply with all applicable marketing and referral regulations
• Not engage in fraudulent or misleading practices
• Understand that commissions are subject to platform policies
• Maintain ethical marketing standards

6. Courier Terms

If you register as a Courier, you agree to:

• Provide valid identification and driver's license
• Maintain valid insurance and vehicle registration
• Deliver orders safely and in a timely manner
• Treat customers and their property with respect
• Comply with all traffic and delivery regulations
• Report any incidents or issues immediately

7. Orders and Payments

7.1 Order Processing

Orders are subject to acceptance by the shop. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing, or suspected fraud.

7.2 Payment

Payment must be made through approved payment methods. All prices are in South African Rand (ZAR) unless otherwise stated. You are responsible for any applicable taxes.

8. Prohibited Activities

You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit harmful code, viruses, or malware
• Engage in fraudulent or deceptive practices
• Harass, abuse, or harm other users
• Interfere with the platform's operation
• Attempt to gain unauthorized access to our systems
• Use automated systems to access the platform without permission

9. Intellectual Property

All content, features, and functionality of the BantuCart platform, including but not limited to text, graphics, logos, images, and software, are owned by BantuCart or its licensors and are protected by copyright, trademark, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law, BantuCart shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

11. Indemnification

You agree to indemnify, defend, and hold harmless BantuCart and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the platform, violation of these Terms, or infringement of any rights of another.

12. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the platform will cease immediately.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or the use of our services shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with South African law.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our platform and updating the "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.
